Woman blames faulty Home Depot insulation blower for damages

WINFIELD – A Kanawha County woman claims a faulty insulation blower rented at Home Depot caused her unnecessary headaches and expenses.

Alice Newman filed her complaint in Putnam Circuit Court against Home Depot USA Inc.

According to her complaint, Newman rented a “Green fiber Cellulose” machine to blow insulation into the attic spaces of her home on November 28, 2019, at the Home Depot location in Teays Valley. That machine didn’t work properly, so she later had to rent another machine to install the “All Borate Cellulose Blow-In” insulation.

She says she rented another “Green fiber Cellulose” machine December 12, 2019, at the Home Depot location in Charleston. But, she says that machine didn’t work properly and hadn’t been properly maintained. That, she says, resulted in the blow-in insulation escaping from the machine and being deposited in the living space of her home.

She says Home Depot knew or should have known the machine wasn’t in merchantable condition and that parts of the machine, namely hoses and fittings, hadn’t been maintained properly.

Newman says she has had to pay for labor, equipment and cleaning supplies to clear the residual blow-in insulation debris from the living space in her home. That includes changing hearing and air filtration units, acquiring additional equipment to complete the insulation project and having to have appliances, components, vents, walls, floors, carpets and window coverings cleaned.

She says she has suffered undue anxiety, inconvenience, mental anguish, emotional distress, stress, annoyance, inconvenience, aggravation, impairment of her capacity to enjoy life, loss of enjoyment of her home during the 2019 holiday season, loss of time, loss of income and loss of compensation from her job as a Registered Nurse as well as other annoyances and inconveniences.

Newman seeks compensatory damages for her losses and injuries, pre- and post-judgment interest, court costs, attorney fees and other relief.
