Woman says she was injured in slip-and-fall at Walmart

CHARLESTON – A Kanawha County woman says she suffered injuries when she fell at Walmart at the start of the pandemic.

Betty A. Stanley filed her complaint March 14 in Kanawha Circuit Court against Wal-mart Stores East.

According to her complaint, Stanley was shopping at the Walmart in Nitro on April 29, 2020, when she slipped and fell because of standing water, sustaining injuries to her head, lower back and buttocks.

A bystander immediately noticed Stanley was bleeding from her head, and someone called for an ambulance.

“Stanley, despite being in considerable pain and bleeding from her head, refused to go with the ambulance as the COVID-19 pandemic had just started to considerably spread in the area, and she did not want to go to the hospital and risk an exposure,” the complaint states. “Stanley began experiencing pain, became increasingly uneasy on her feet … and eventually noticed the pain increasing.”

On June 29, 2020, Stanley says she visited Charleston Area Medical Center’s Emergency Room after she fell again because of her uneasiness on her feet and the pain had become unbearable. She eventually released from the ER.

On July 20, 2020, Stanley says her pain became so unbearable again she had to call an ambulance to take her to the ER.

Since the incident, Stanley said she has had to get treatment for her lower back pain related to the slip and fall.

She accuses Walmart of negligence for causing her to fall because of an unsafe and hazard-filled walking area.

Stanley seeks compensatory damages, pre- and post-judgment interest, court costs and other relief.

She is being represented by Ronald N. Walters Jr. of Walters Law Firm in Charleston. The case has been assigned to Circuit Judge Joanna Tabit.
