Man says real estate agents, companies backed out to to sell to someone else

CHARLESTON — A Charleston man is suing Old Colony Company of Greater Kanawha Valley alleging they sold him a piece of property and then backed out to sell it to someone else.

Old Colony Holding Company, Property Elite, Misti Beach, Cathy Underwood, Craig Allison, Joe Miller, Raymond Yi and Sophia Chang were also named as defendants in the suit.

Randal Eugene Sigman offered $5,000 to purchase property in Kanawha County on Oct. 13, 2021, and the offer was accepted by Yi and Chang, who were the sellers, according to a complaint filed in Kanawha Circuit Court.

Sigman claims the following day a purchase agreement was provided and the parties signed it.

After the execution by both parties, Beach contacted the plaintiff to inform him that another realtor had already sold the property to another purchaser after the purchase agreement had already been signed by the sellers and Sigman, according to the suit.

Sigman claims he declined to terminate the purchase agreement and informed Beach that he intended to enforce the purchase agreement and requested to close on the property. He did not receive a response from Beach, or from others he contacted via email or by phone. His counsel sent a notice of intent to close on Oct. 20, 2021, at 3 p.m. at Pierson Legal Services.

On Oct. 20, 2021, the plaintiff arrived at Pierson Legal Services with cash to purchase the property and no other party appeared, according to the suit. He claims the purchase agreement is a fully executed contract enforceable by law.

Sigman claims the defendants misrepresented their authority to act on behalf of the sellers and attempted to induce him to enter into a cancelation of a purchase agreement. He claims entering into another contract with a different purchaser constituted fraud, misrepresentation and civil conspiracy.

Sigman is seeking for the purchasing agreement to be enforced and for compensatory and punitive damages. He is represented by James M. Pierson of Pierson Legal Services in Charleston.

The case is assigned to Circuit Judge Joanna Tabit.
