Greenbrier man sues WVDCR after he claims he didn't receive proper medical care while detained

CHARLESTON — A Greenbrier County man is suing the West Virginia Division of Corrections and Rehabilitation alleging they ignored him when he needed medical care.

Unknown and unnamed employees were also named as defendants in the suit.

Adam Taylor Wade was incarcerated at Southern Regional Jail on Dec. 18, 2019, in Raleigh County and at the time of his incarceration, he was injured, including a fracture of the shaft of the left humorous with a 2cm displacement, according to a complaint filed in Kanawha Circuit Court.

Wade claims the jail was made aware of his injuries and advised that he needed follow-up medical care and a follow-up visit to his treating physicians in the next seven days.

On Dec. 30, 2019, he was transported to Beckley Appalachian Regional Hospital, where he had to have emergency surgery to set the spiral fracture of the left humeral shaft and relieve acute left radial nerve palsy, according to the suit,

Wade claims the defendants did not help him or insist that he receive medical care in a timely manner when he desperately needed it and, instead, took steps to ensure that he would be ignored.

The plaintiff was clearly in a state of acute medical crisis and his distress was so patently obvious that even a layperson would recognize the need for medical intervention, according to the suit.

Wade claims the defendant's employees chose to ignore his distress and failed to conduct adequate checks and supervision of his condition to ensure that he was safe and in good health.

Wade claims the defendants violated his civil rights and caused him distress.

Wade is seeking compensatory and punitive damages. He is represented by Russell O. Wooton of Wooton Law in Beckley.

The case is assigned to Circuit Judge Joanna Tabit.
