Man sues correctional officers for injuries

CHARLESTON — A man is suing two correctional officers claiming he was injured while incarcerated.

Correctional Officers White and Wilson were employed by the West Virginia Division of Corrections and Rehabilitation.

Michael Radcliff was incarcerated at Mount Olive Correctional Complex, according to a complaint filed in Kanawha Circuit Court.

Radcliff claims the defendants repeatedly assaulted him after he was placed in restraints on Dec. 22, 2019.

"At no time did plaintiff resist defendants or fail to follow orders," the complaint states. "The Defendants...handcuffed plaintiff through the bean hole and proceeded to taze plaintiff on his arms, twist his fingers and wrists, thereby breaking plaintiff's pinky finger."

Radcliff claims his injuries required outside medical attention and she was also sprayed with pepper spray when he was not posing a threat to himself or the correctional officers.

"Defendants also attempted to cover up their wrongful conduct by filing false reports," the complaint states.

Radcliff claims while he was being assaulted, the defendants also made malicious comments to him.

The defendants' actions were battery and a violation of the U.S. constitution, according to the suit.

Radcliff is seeking compensatory and punitive damages. He is represented by Paul M. Stroebel of Stroebel & Stroebel in Charleston.

The case is assigned to Circuit Judge Ken Ballard.
