Man accuses two doctors of malpractice, failure to properly diagnose

CHARLESTON – A Putnam County man is accusing two Charleston physicians of medical malpractice.

James Eads filed his complaint in Kanawha Circuit Court against Dr. Michael Beasley; Ear, Nose & Throat Associates of Charleston Inc.; Dr. Shailendra Singh and Charleston Gastroenterology Associates PLLC.

According to his complaint, Eads was referred to Beasley at Ear, Nose & Throat Associates for treatment on January 21, 2020, for a history of recurrent bilateral epistaxis and anemia. He says Beasley deviated from the standard of care by failing to diagnose Eads with arteriovenous malformation as the cause.

Three days later, Eads was referred to Singh at Charleston Gastroenterology for his anemia. He says Singh deviated from the standard of care by cauterizing non-bleeding arteriovenous malformations in his color during a diagnostic colonoscopy and causing the wall of his colon to be perforated.

He says the complications from both doctor visits have caused him serious and permanent injury.

Eads accuses Beasley and Singh of professional negligence, and he accuses the two businesses of vicarious liability.

He seeks compensatory damages for medical expenses, pain and suffering, loss of earnings, annoyance, embarrassment, humiliation, inconvenience and loss of enjoyment of life. He also seeks punitive damages, pre- and post-judgment interest, attorney fees, court costs and other relief.

Eads is being represented by Richard D. Linday II and Dr. Richard D. Lindsay of Tabor Lindsay & Associates. The case has been assigned to Circuit Judge Jennifer Bailey.
