PHILIPPI — A woman is suing Audubon Animal Clinic alleging she was injured on its premises in 2020.
Linda Durrett was in the waiting room of Audubon Animal Clinic on Feb. 10, 2020, and was walking through when she tripped and fell on an animal scale sitting in the walkway and injured her arms and hands, according to a complaint filed in Barbour Circuit Court.
Durrett claims the defendant was negligent in its maintenance of the floors and walkways on the clinic premises and that negligence was the actual and proximate cause of the fall and Durrett's injuries.
The defendant allegedly caused Durrett to sustain physical injuries that could be permanent, as well as mental anguish, inconvenience, and the expense of seeking medical attention, according to the suit.
Durrett claims she suffered damages to her personal property in the fall and experienced annoyance, inconvenience and loss of use of her property,
"Defendant Corporation's negligent maintenance of the floors and walkways located on the premises of the Defendant Corporation are the actual and proximate cause of the Plaintiff's fall and her injuries described herein," the complaint states.
Durrett claims she was taking her dog to be seen by the vet when the incident occurred, according to the suit.
The plaintiff sustained injuries to her hands and her arms because of the defendant's negligence, according to the suit.
Durrett is seeking compensatory and punitive damages with pre- and post-judgment interest. She is represented by Phillip S. Isnerof Isner Law Office in Elkins.
