Cabell County man says water company fired him because of his age

CHARLESTON – A Cabell County man accuses West Virginia-American Water Company of age discrimination.

Earl Dishman filed his complaint July 28 in Kanawha Circuit Court against American Water Works Service Company, American Water Works Company, West Virginia-American Water Company and Chris Carew.

According to his complaint, Dishman worked for WVAWC from December 2005 until August 28, 2020. He says he performed his work duties in a satisfactory manner.

When he was fired, Dishman was 50 years old. He says the person hired to replace him was under 30. Dishman says he was discharged because of his age.

As a result of his firing, Dishman says he has suffered and will suffer lost wages and benefits as well as indignity, embarrassment and humiliation. He seeks compensatory damages as well as punitive damages. He also seeks back pay, front pay, pre-judgment interest, attorney fees, court costs and other relief.

Dishman is being represented by Mark A. Atkinson of Atkinson & Polak of Charleston. The case has been assigned to Circuit Judge Tera Salango.
