ELKINS — A Pittsburgh woman is suing Walgreens claiming she was injured while at one of its locations in West Virginia.
Jillian M. Huber was a retail customer at the Buckhannon Walgreens store on May 31, 2020, when she fell in the parking lot and was injured, according to a complaint filed in U.S. District Court for the Northern District of West Virginia.
Huber claims she parked her vehicle and exited it, but upon placing her right foot on the ground, it went into a defect in the parking lot and caused her to suffer inversion injuries to her right ankle.
The plaintiff severely sprained her ankle, and suffered a fracture to her ankle cartilage, right lateral ankle instability and a split tear of the peroneus longus tendon. She had to have extensive medical treatment, including multiple surgical repairs, according to the suit.
"The defect in the Defendants’ parking lot turned out to be a round hole that was several inches deep beneath the level of pavement, but which had been filled with and obscured by dirt, dust and gravel that made it difficult to distinguish from the surrounding pavement," the complaint states. "Moreover, the defect in question was located at the edge of the Plaintiff’s parking space such that it was positioned where one would normally place their feet as they exited a vehicle, but which would, in that position, be obscured from a driver’s view by the bottom portion of their vehicle."
As a result of the defendant's negligence, the plaintiff suffered severe and debilitating injuries and damages, according to the suit.
Huber is seeking compensatory damages. She is represented by T. Keith Gould of The Miley Legal Group in Clarksburg.
The case is assigned to District Judge Tom Kleeh.
