Mother sues Benwood, YMCA for son's injuries from city pool

MOUNDSVILLE — A woman is suing the YMCA and the City of Benwood alleging her young son was injured at Benwood Pool during summer camp.

On Aug. 3, 2021, Landon Lanham, the son of Rebecca Lanham, was under the direct care and supervision of the YMCA and Benwood while he was part of a daytime child care camp program, according to a complaint filed in Marshall Circuit Court.

The defendants negligently failed to select appropriate activities for children in the summer camp and failed to provide adequate supervision of those activities, according to the suit.

Rebecca Lanham claims her six-year-old son sustained life-altering injuries and damages because he was not properly supervised, including a head injury, head contusions, two black eyes, a concussion, post-concussion syndrome, headaches, dizziness and light sensitivity,

Landon Lanham was injured during an activity that was dangerous and unsafe wherein boys and girls who were not suited to climb and/or jump off the high dive at Benwood pool were permitted to do so. Landon Lanham fell from the high dive and sustained serious injuries.

The defendants were negligent and caused Landon Lanham's injuries, according to the suit.

Rebecca Lanham claims the high diving board wasn't safe or fit for its intended use. She claims her child suffered and will continue to suffer injury, harm, and economic losses because of the incident.

"Plaintiff's ... permanent injuries have adversely affected his ability to enjoy the ordinary functions of life, together with the capability to function as a while person; and all of which will continue in the future," the complaint states.

Rebecca Lanham is seeking compensatory damages with pre- and post-judgment interest. She is represented by Ronald W. Zavolta, Paul J. Ratcliffe and Michael P. Zavolta of Zavolta Law Office in Wheeling.

The case is assigned to Circuit Judge David Hummel.
