Woman sues nursing home defendants for family member's injuries, death

HUNTINGTON — A woman is suing several nursing home-related entities for injuries her family member sustained during his residency and his eventual death.

St. Mary's Medical Center, Mountain Health Network, Heritage Center and Genesis Healthcare were all named as defendants in the suit.

Michael T. Holstein was a nursing home resident of the defendants beginning Jan. 7, 2021, according to a complaint filed in Cabell Circuit Court.

Willette L. Frye claims during Holstein's residency, the defendants failed to provide a safe environment for him and failed to provide adequate supervision.

The negligence and carelessness of the defendants contributed substantially to Holstein's injuries, pain and suffering, according to the suit.

Frye claims the defendants failed to provide preventative measures to prevent Holstein from pressure-related skin injuries and because of that negligence, Holstein suffered from skin injuries that caused him to decrease functional mobility and required skilled inpatient rehabilitation.

The defendants failed to keep Holstein and his family members informed of his total health status and his medical conditions during his residency and failed to provide a sufficient number of staff to provide adequate and appropriate nursing care, according to the suit.

Frye claims the defendant failed to provide health care services in compliance with state law and applicable federal and state rules and regulations and with acceptable professional standards and principles applicable to the personnel providing said services.

The defendants were negligent and at fault for Holstein's wrongful death, according to the suit.

As a direct and proximate result of the defendant's negligence, the plaintiff and Holstein's estate have incurred medical expenses and funeral expenses, according to the suit.

Frye is seeking compensatory and punitive damages. She is represented by Jeff D. Stewart, Andrew L. Paternostro, S. Andrew Stonestreet and Michelle L. Barker of Stewart Bell in Charleston.

The case is assigned to Circuit Judge Gregory L. Howard Jr.
