HUNTINGTON — A woman is suing Cabell Huntington Hospital claiming after she was injured after surgery when an unknown hospital employee was helping her from the hospital bed to a wheelchair.
An unknown employee known as Jane Doe was also named as a defendant in the suit.
Kerry L. Carter was a patient and was being prepped for an outpatient surgery when she was administered general anesthesia and a femoral nerve block to repair a torn labrum of the left him and correction of an anatomical abnormality within the left hip, according to a complaint filed in Cabell Circuit Court.
The plaintiff arrived in the PACU for transport with a wheelchair and patient she was told to sit up in bed and place both feet on the floor, but when she did, her weight shifted and she fell to the floor.
Carter claims Doe was negligent in her medical care and attempted transport of the plaintiff.
Carter claims Doe deviated from the appropriate standard of care for a medical provider by failing to adequately assist and support the plaintiff's weight during the attempted transfer.
The defendants failed to evaluate and appropriately assess the plaintiff's post-anesthesia and post-block condition and ability or inability to support her own body weight, according to the suit.
Carter claims the defendant failed to inform her of a safe alternative, such as delaying the attempted transport to allow the block and anesthesia time to lessen or diminish.
Carter is seeking compensatory and punitive damages with pre- and post-judgment interest. She is represented by Timothy L. Eves of Eves Law Firm in Huntington.
The case is assigned to Circuit Judge Christopher Chiles.
