West Virginia Office Secures Complete Defense Verdict in Legal Malpractice Matter

Weirton Partner Michelle L. Gorman recently secured a significant victory on behalf of a family law attorney in a legal malpractice matter when a jury returned a verdict in favor of Lewis Brisbois’ client.

In the underlying matter, Lewis Brisbois’ attorney client had represented the wife in a divorce action that involved numerous issues, including spousal support and federal employee benefits. Following the resolution of the matter by way of a mediated property settlement agreement, the wife filed suit against her attorney. She alleged claims of legal malpractice, breach of contract, intentional infliction of emotional distress, and violations of the West Virginia Consumer Protection Act. In support of her claims, she contended that she should have received permanent spousal support and that she should have been advised of additional federal benefits. The matter ultimately proceeded to trial in Harrison County, West Virginia, after the plaintiff rejected a settlement offer.

During trial, Lewis Brisbois obtained judgment as a matter of law on the Consumer Protection Act claims, and the remaining claims were submitted to the jury. After deliberating for just under an hour, the jury returned a complete defense verdict on the legal malpractice, breach of contract, and intentional infliction of emotional distress claims.
