Lawsuit claims Copper Fit gloves are defective after sawing accident

CLARKSBURG — A Harrison County couple is suing Ideavillage Products Corp. claiming they are responsible for negligently manufacturing gloves.

IDVC LLC also was named as a defendant in the suit.

Lisa Rue purchased a pair of the defendants' Copper Fit Compression Gloves on June 1, 2020, for her husband, Albert Rue, according to a complaint filed in U.S. District Court for the Northern District of West Virginia.

Albert Rue was wearing the gloves for the first time on July 17, 2020, and was installing baseboards and trim in the bathroom of their home, according to the suit.

The Rues claim Albert Rue was cutting the trim with his miter saw when the strap of the left glove popped loose and pulled his hand into the saw blade, resulting in the total amputation of his left hand.

On the way to the emergency room, the plaintiffs were involved in a car accident that resulted in more personal injuries and the Rues were taken to Ruby Memorial Hospital after emergency personnel arrived at the car accident site, according to the suit.

Albert Rue then was taken to Allegheny General Hospital for reimplantation of his hand and remained hospitalized until Aug. 22, 2020.

The Rues claim the defendants were negligent in their design, manufacture, development, production, marketing, distribution, promotion, advertising, distribution and sale of the gloves.

The defendants breached their express and implied warranties and are responsible for the plaintiffs' injuries, according to the suit.

In their answer, the defendants deny that they are liable for the demand for judgment and contend that the plaintiffs may be barred by the applicable statute of limitations and/or the doctrine of laches. 

"The damages or losses of which Plaintiffs complain were not in any manner caused or contributed to by any wrongful act or omission on the part of Defendants," the answer states.

The Rues are seeking compensatory damages with pre- and post-judgment interest. They are represented by Michael D. Crim of Crim Law Office in Clarksburg. The defendants are represented by Ellen M. Jones and J. David Bolen of Dinsmore & Shohl in Huntington.
