CHARLESTON — A woman says Dollar General is responsible for injuries she sustained when she fell at one of its locations.
Dolgencorp LLC and an unknown and unnamed employee and manager were also named as defendants in the suit.
Joan K. Shafer was shopping at Dollar General in Sissonville when her foot caught on the upturned corner of an outdoor rug that was near the front door, according to a complaint filed in Kanawha Circuit Court.
Shafer claims she tripped over the rug, fell and injured her right shoulder, leg and kidneys, as well as other parts of her body.
"The condition of the rug and its curling/upturning was not readily apparent to the Plaintiff, a customer of the store," the complaint states. "However, the dangerous condition of the rug was known or should have been known to defendants."
The defendants and a customer witnessed the plaintiff fall and assisted her. One of the unknown/unnamed defendants helped Shafer to her vehicle so that she could leave the premises, according to the suit.
Shafer claims she sought medical attention the following day and was hospitalized as a result of the kidney injury and had to undergo extensive physical therapy and injection therapy for her shoulder, as well as significant and lasting weakness in her right shoulder that limited her mobility.
The plaintiff incurred substantial medical bills in the amount of $33,375, according to the suit.
Shafer claims the defendants were negligent.
Shafer is seeking compensatory and punitive damages. She is represented by W. Jesse Forbes and Jennifer N. Taylor of Forbes Law Offices in Charleston.
The case is assigned to Circuit Judge Tera Salango.
