Woman sues CAMC for husband's injuries, death

CHARLESTON — A woman is suing Charleston Area Medical Center alleging they are responsible for her husband's death.

Darla Bird filed the lawsuit on behalf of the estate of her late husband, Jeffrey Bird.

Jeffrey Bird was hospitalized from Nov. 20, 2020, until Jan. 5, 2021, at Charleston Area Medical Center, according to a complaint filed in Kanawha Circuit Court.

Darla Bird claims CAMC deviated from the applicable standard of care for Jeffrey Bird and failed to adequately identify pressure risks, lack of consulting in appropriate time frames, negligent care planning and negligent treatment.

Jeffrey Bird developed pressure sores and suffered physical and mental pain and suffering, severe emotional distress and medical expenses until his eventual death, according to the suit.

"As a further and direct proximate result of the negligence of Defendant...Jeffrey Bird, deceased, did suffer from pressure ulcers on his sacrum, as a result of the defendant's failure to provide adequate treatment," the complaint states.

Darla Bird claims the defendant caused him to suffer sacral pressure ulcers and the defendant failed to properly recognize and remedy the sacral pressure ulcers.

Darla Bird claims the defendant was willful, wanton and reckless in its disregard of Jeffrey Bird's well-being and health.

Darla Bird is seeking compensatory and punitive damages with pre- and post-judgment interest. She is represented by Charles M. Love IV of The Love Law Firm in Charleston.

The case is assigned to Circuit Judge Tera Salango.
