Woman sues PDK Construction for injuries from guardrail

WINFIELD — A Putnam County woman is suing PDK Construction alleging she was injured in an accident due to a guardrail.

Hanna Thomas was operating an all-terrain vehicle on private property in Frazier's Bottom on May 27, 2019, and struck a section of guardrail that caused her to wreck and sustain personal injuries and damages, according to a complaint filed in Putnam Circuit Court.

Thomas claims on April 27, 2021, she filed a complaint in Putnam Circuit Court against the West Virginia Department of Transportation for negligence and causing her personal injuries and during discovery, PDK was identified as the owner of the guardrail and the party responsible for the guardrail repair and removal.

"Through reasonable due diligence, the Plaintiff first learned of any potential claims against the Defendant on or about May 12th, 2022," the complaint states.

The defendant was negligent in failing to remove the guardrail from the property, causing the ATV accident and caused Thomas to suffer injuries, according to the suit.

Thomas claims she sustained personal injuries and damages, sustained permanent injuries, incurred hospital and medical bills and expenses, and will incur a loss of enjoyment of life, forced to retire early and will continue to suffer pain and body of mind.

Thomas is seeking compensatory damages with pre-judgment interest. She is represented by Clayton J. Maddox and Bert Ketchum of Green Ketchum Bailey & Tweel in Huntington.
