Erie sues TA Operating for car accident

WINFIELD — Erie Insurance Exchange is suing TA Operating for a car accident.

TA Operating is doing business as Travel Centers of America.

On Feb. 19, 2021, a truck owned by TA Operating and operated by one of TA Operating's employees, collided with a 2016 Mitsubishi Outlander driven by Mitzi Eagle, according to a complaint filed in Putnam Circuit Court.

Eagle's vehicle was insured by Erie and it needed repairs due to the collision, according to the suit.

"As a result of the collision, the Insured submitted claim(s) to Plaintiff for the damages to the Insured's vehicle," the complaint states. "Pursuant to the terms and conditions of the Insured's policy of insurance, Plaintiff honored the claim(s) and reimbursed the Insured and/or third parties on her behalf, the sum of $8,199.67."

Erie claims the defendant now needs to reimburse it the $8,199.67 that it paid to its insured.

"The Insured's vehicle was damaged in the collision and required repairs," the complaint states. "The collision and the resulting damages to the insured's vehicle were directly and proximately caused by the negligence and/or recklessness of the defendant's employee."

Erie is seeking damages in the amount of $8,199.67 plus statutory post-judgment interest and costs of the court action. Erie is represented by Ryan S. Marsteller of Bailes, Craig, Yon & Sellards in Huntington.
