Former security guard accuses company of age discrimination

CHARLESTON – A Clarksburg man accuses a security company of age discrimination.

Earl Young filed his complaint in Kanawha Circuit Court against Universal Protection Service doing business as Allied Universal Protection Service. Young was born April 25, 1950.

According to the complaint, Young was hired by the defendant in 2014 as an armed security guard. He requested vacation time for July 5-8, 2022, and it was approved.

When he returned to work July 12, 2022, he was told he no longer had a job and had been replaced by a “much younger individual.” Young was 71 years old at the time of his termination.

He accuses the defendant of age discrimination and intentional infliction of emotional distress.

Young seeks compensatory damages for lost wages and benefits, back pay, front pay, indignity, embarrassment, humiliation, annoyance, inconvenience and emotional distress. He also seeks pre- and post-judgment interests, attorney fees, court costs and other relief.

He also seeks to enjoin the defendant from engaging in such discriminatory practices.

Young is being represented by Paul E. Biser of Fredeking & Biser Law Offices in Huntington. The case has been assigned to Circuit Judge Joanna Tabit.
