CHARLESTON — A man is suing the estate of the man who murdered his mother, claiming wrongful death and conversion.
Steven A. Sloan shot and killed his ex-wife, Kathryn Marie Sloan, on July 17, before killing himself, according to a complaint filed in Kanawha Circuit Court.
Adam M. Duston, the administrator of the estate of Kathryn Sloan filed the lawsuit against Stephanie Sloan, individually and as administratrix of the estate of Steven A. Sloan, for Kathryn Sloan's wrongful death.
Duston claims Kathryn Sloan and Steven Sloan were married in 2008 and divorced on July 6, 2022.
He claims after Kathryn Sloan's death, Stephanie Slaon converted certain personal property owned by her or her family to her own use or to the use of the estate of Steven Sloan.
"Stephanie Sloan has prevented the Plaintiff, Adam M. Duston, from accessing the property of his mother, by changing locks and is now attempting to sell property owned by either or both of the decedents for the purposes to defraud the Plaintiff, which is a creditor of the Estate of Steven A. Sloan," the complaint states.
Duston is seeking compensatory and punitive damages. He is represented by Michael J. Del Giudice of Ciccarello, Del Giudice & LaFon in Charleston.
Stephanie Sloan filed a counterclaim in Kanawha Circuit Court. Duston then filed an answer to the counterclaim.
The counterclaim fails to state a cause of action against Duston for which relief can be granted, according to the answer to the counterclaim.
Duston requests that the court dismiss the counterclaim and award the plaintiff the costs and expenses incurred in defending the counterclaim.
The case is assigned to Circuit Judge Kenneth Ballard.
