Man sues Turley's Paint & Body for work injuries

CHARLESTON — A man is suing Turley's Paint & Body claiming he was injured while on the property performing work.

Chris Turley is doing business as Turley's Paint & Body.

Ellis Greene was at Turley's on June 15, 2022, conducting business and helping to unload a carnival ride when he was struck by a forklift, according to a complaint filed in Kanawha Circuit Court.

Greene claims he was helping to unload the ride when he was hit by the forklift, which harmed him.

Greene claims the defendant's employee and/or agent was operating the forklift when they operated it in a negligent and reckless fashion and failed to keep a proper lookout.

"As a direct and proximate result of being struck by the forklift, the Plaintiff suffered serious and permanent personal injuries for which he seeks a recovery against the Defendant herein," the complaint states. 

Greene claims he was lawfully present at the business when the injury occurred and the defendant breached its duties of care owed to him by negligently operating the forklift in a negligent and reckless manner.

The defendant's actions caused the plaintiff to suffer severe and permanent injuries, according to the suit.

Greene claims he endured physical and emotional pain and suffering; physical scarring; emotional distress; mental anguish; loss of enjoyment of life; annoyance and inconvenience; and other damages.

"Plaintiff has had to undergo medical treatment as a result of being struck by Defendants' forklift, and medical expenses were incurred relative to the same, and he is likely to require medical treatment in the future for the injuries he suffered as a direct and proximate result of the subject incident..." the complaint states.

Greene is seeking compensatory damages with pre- and post-judgment interest. He is represented by Mark E. Troy of Morgan & Morgan in Charleston.

The case is assigned to Circuit Judge Maryclaire Akers.
