Man sues SMMC for pressure sores

HUNTINGTON — A Lincoln County man is suing St. Mary's Medical Center after he developed a large pressure sore despite the hospital being made aware that he was at a high risk of developing them.

Jackie Weaver was admitted to St. Mary's on Nov. 23, 2020, according to a complaint filed in Cabell Circuit Court.

Weaver claims when he was admitted, he had no skin integrity issues, however, on Nov. 25, 2020, he received a Braden score that indicated that he was at risk for the development of pressure sores.

Despite the score, Weaver's records at St. Mary's show no measures taken until Nov. 28, 2020, to prevent pressure sores from occurring, according to the suit.

Weaver claims on Nov. 28, 2020, he developed a red area that was the beginning of a sacral pressure sore and by Dec. 1, 2020, he had developed a large pressure sore.

St. Mary's was negligent in failing to take the appropriate steps to prevent the occurrence of a sacral sore and in failing to realize upon his admission that he would need additional measures of prevention, according to the suit.

Weaver claims his function and cognition have been adversely affected by the chain of consequences from the pressure ulcers that he received while in the care of St. Mary's.

"Jackie Weaver suffered pain and suffering, mental anguish, incurred medical expenses, has a permanent injury and will require future medical expenses and will undergo future pain and suffering and mental anguish due to the below-accepted standards of medical care delivered by St. Mary's Medical Center," the complaint states.

Weaver is seeking compensatory damages. He is represented by Donald R. Capper of Proctorville, Ohio, and C. Joseph Stevens of Hamlin.

The case is assigned to Circuit Judge Alfred Ferguson.
