HUNTINGTON — An Ona woman is suing University Physicians & Surgeons claiming a surgeon was negligent during a procedure and caused her more injuries.
Dr. Farzad Amiri was also named as a defendant in the suit.
Mary Zarilla presented to St. Mary's Medical Center on Dec. 18, 2020, with a diagnosis of biliary dyskinesia and cholecystitis and was taken to the operating room by Amiri for a cholecystectomy, according to a complaint filed in Cabell Circuit Court.
During the procedure, Amiri performed an intraoperative cholangiogram after placing a clip distally on what he identified as the cystic duct, according to the suit.
Zarilla claims three days after the procedure, she presented to Cabell Huntington Hospital with nausea, vomiting, increased abdominal pain, fatigue, fever, chills and general malaise and was admitted.
The following day, an endoscopic retrograde cholangiopancreatography was performed and revealed a stricture, which was consistent with the duct having been clipped during the Dec. 18, 2020, procedure, according to the suit.
Zarilla claims a stent was placed, but she had to undergo several procedures in order to replace stents and address the stricture.
Amiri was negligent in the dissection and placing of the clip, according to the suit.
Zarilla claims the defendants also negligently failed to properly read or interpret the first intraoperative cholangiogram and failed to exercise a degree of skill, care and learning required under the circumstances.
Zarilla is seeking compensatory damages with pre- and post-judgment interest. She is represented by Kevin M. Pearl of Frankovitch, Anetakis, Simon, DeCapio & Pearl in Weirton.
