Woman says CAMC responsible for man's wrongful death

CHARLESTON — A woman is suing Charleston Area Medical Center alleging it is responsible for a man's death.

Dr. Jonathan Christopher Neuman was also named as a defendant in the suit.

Lindsey Lutsie, as administratrix of the estate of Taylor Ray Anderson, filed the lawsuit for negligence and medical malpractice.

Anderson died on Feb. 14, 2021, from a hemorrhagic cerebral infarction while in the ICU at Charleston Area Medical Center, according to a complaint filed in Kanawha Circuit Court.

Lutsie claims Anderson was admitted on Feb. 12, 2021, to CAMC to undergo diagnostic imaging studies, but was not given additional bloodwork.

Anderson was discharged and two days later he was readmitted to CAMC with altered mental status and had to have endotracheal intubation, according to the suit.

"After an initial workup in the CAMC Emergency Department, Mr. Anderson was admitted to ICU suffering from severe sepsis, with distributive shock and thrombocytopenia," the complaint states.

Lutsie claims Anderson died at 9:17 p.m. that night in the ICU.

The defendants were negligent during the Feb. 12, 2021, hospital visit and they breached the applicable standard of care, according to the suit.

Lutsie claims the defendants failed to consider his high risk of meningitis, endocarditis and stroke given his reporting condition and history. 

Lutsie also claims the defendants also failed to obtain additional bloodwork and diagnostic studies and failed to affirmatively recommend that he remain in the hospital for additional care and treatment.

"In accepting responsibility to treat Mr. Anderson, Dr. Neuman had a duty to exercise the reasonable and ordinary care, skill and ability exercised by other healthcare providers in the same or similar circumstances," the complaint states.

Lutsie is seeking compensatory and punitive damages. She is represented by L. Dante DiTrapano and Timothy D. Houston of Calwell Luce DiTrapano; and Richard D. Lindsay II and Dr. Richard D. Lindsay of Tabor Lindsay & Associates in Charleston.

The case is assigned to Circuit Judge Louis Bloom.
