CHARLESTON — The West Virginia Department of Transportation Division of Highways is suing Advanced Building Services for damages from a one-vehicle accident that damaged a bridge.
Gage Michael Borosh was also named as a defendant in the suit.
Borosh, who was employed by ABS, was operating a 2013 Peterbilt semi-truck owned by ABS in Wetzel County on Jan. 12, 2021, and negligently rounded a curve, causing him to connect with a concrete bridge structure and damaging a concrete pillar and lighting unit on the bridge, according to a complaint filed in Kanawha Circuit Court.
DOH claims Borosh then continued to drive the semi-truck before being stopped by an off-duty police officer, Joshua C. Cecil.
The incident occurred on U.S. 69 in Wetzel County, according to the suit.
The defendants are indebted to the DOH in the amount of $14,083.74 for damages incurred during the incident, according to the suit.
DOH claims Borosh operated the vehicle in a negligent manner to cause the accident and damages and ABS is responsible as the owner of the vehicle.
"As a direct and proximate cause of the negligence of the Defendants...the Plaintiff has incurred costs and damages in the amount of ... ($14,083.74)," the complaint states.
DOH is seeking compensatory damages in the amount of $14,083.74 with interest and attorney fees. It is represented by Stacy A. Jacques of the DOH's Legal Division in Charleston.
The case is assigned to Circuit Judge Tera Salango.
