CHARLESTON — A woman is suing Harrell Memorial Nursing Home Inc. for injuries sustained by her family member while she was a resident.
Harrell is doing business as Meadowbrook Acres Nursing Center.
Nursing Care Management of America was also named as a defendant in the suit.
Phyllis C. Shrewsbury was a resident at the nursing home from Aug. 24, 2021, until her death on Nov. 4, 2021, after she suffered a fall, according to a complaint filed in Kanawha Circuit Court.
Sharon Wall claims when Shrewsbury was admitted, she and her family expected Meadowbrook to provide her with quality care, but the defendants failed to provide adequate supervision and safety devices tp prevent her from suffering a fall on Nov. 4, 2021, which caused a closed head injury and scalp laceration.
Wall claims Shrewsbury was admitted to the hospital and then died.
Meadowbrook had a duty to provide Shrewsbury with appropriate health care and protective and support services, according to the suit.
Wall claims the defendants failed to keep Shrewsbury and her family fully informed of her total health status and failed to provide a sufficient number of staff to provide adequate and appropriate nursing care to its residents.
The defendants' acts and omissions during the relevant time period also violated her right to be treated courteously, fairly and with the fullest measure of dignity, according to the suit.
Wall claims Shrewsbury sustained infringements of her rights as a nursing home resident at the defendants' nursing home facility.
The injuries Shrewsbury sustained during her fall led to her death and the estate incurred funeral expenses, according to the suit.
Walls is seeking compensatory and punitive damages. She is represented by Jeff D. Stewart, Andrew L. Paternostro, Katherine H. Arritt and Allison R. Santer of Stewart Bell PLLC in Charleston.
The case is assigned to Circuit Judge Maryclaire Akers.
