CHARLESTON – A Logan man has sued Golden Corral after he says he suffered a severe case of food poisoning from eating at the Cross Lanes location.
William Allred filed his complaint in Kanawha Circuit Court against Golden Corral Franchising Systems Inc. and CSG Enterprises Corporation.
According to the complaint, Allred was having a family outing on February 26 at the Golden Corral.
“After ingesting a significant portion of his meal, he soon discovered that he had consumed undercooked roast beef,” the complaint states, adding Allred suffered gastrointestinal distress. Allred says he also required a new beverage because of a “chemical-like taste” in the first one. The server told him and his family the staff knew of the issue.
“Notable, on this particular day, the defendant appeared to be understaffed with an extremely low supply of food at the buffet areas for the amount of customers inside of the restaurant,” the complaint states. “Multiple customers complained to the wait staff of the lack of edible food and supply such as dishes, cutlery, etc.”
That evening, Allred says he became very ill and suffered extreme symptoms of food poisoning such as diarrhea, abdominal cramping, headache and fatigue. Because of the severity of his symptoms, Allred sought medical treatment at Logan Regional Medical Center.
He accuses the defendant of negligence, negligent infliction of emotional distress and unlawful sales practices in violation of West Virginia consumer protection statutes. He alleges the defendant knowingly misled him to believe it was following West Virginia Board of Health practices and state laws.
Allred seeks compensatory damages, attorney fees, court costs and other relief.
He is being represented by Michael Cary of Cary Law Office in Charleston. The case has been assigned to Circuit Judge Maryclaire Akers.
