Woman says she slipped on grape in floor at South Hills Kroger

CHARLESTON – A Charleston woman says she was injured says she was injured after she stepped on a grape, slipped and fell at the Kroger in South Hills.

Charlene Johnson filed her complaint May 26 in Kanawha Circuit Court against Kroger.

According to the complaint, Johnson was shopping at the store on Fledderjohn Road on May 29, 2021. She says she stepped on a grape that had been left on the floor and stuck her knee on the floor, causing injury and straining her lower back. Johnson was taken to the hospital via ambulance.

She blames Kroger’s negligence of failing to maintain its premises in a safe manner for her injuries. She says she has endured physical pain and suffering, medical expenses, loss of ability to enjoy life, humiliation, embarrassment, annoyance, aggravation, inconvenience and other injuries.

Johnson seeks compensatory, special and general damages, pre- and post-judgment interests, court costs, attorney fees and other damages and relief.

She is being represented by Joshua R. Martin of The Martin Law Firm in Nitro. The case has been assigned to Circuit Judge Maryclaire Akers.
