Woman says she was injured while shopping at Gabe's

CHARLESTON – A Charleston woman blames a retailer for her slip-and-fall injury.

Theresa Whitehead filed her complaint May 26 in Kanawha Circuit Court against Gabriel Brothers Inc. doing business as Gabe’s.

According to the complaint, Whitehead was shopping at Gabe’s store August 11, 2021, in Kanawha City when she slipped and fell on a liquid substance in an aisle of the store.

She says there were no caution signs warning customers of hazardous conditions, and she says Gabe’s did not take any action to correct the condition.

After recuperating and gaining her strength back, Whitehead says she left the store. But, she says she sought medical treatment at Charleston Area Medical Center for ongoing pain and injuries.

She says she sustained a ruptured or herniated disk and lumbosacral strain. She says she also required surgery with a neurosurgeon.

Whitehead accuses Gabe’s of negligence and negligent infliction of emotional distress. She seeks compensatory damages, court costs, attorney fees and other relief.

She is being represented by Michael Cary of Cary Law Office in Charleston. The case has been assigned to Circuit Judge Carrie Webster.
