Woman says she was injured in convenience store parking lot

CHARLESTON – A Ravenswood woman says she was injured in a convenience store parking lot.

Patricia Leighann Flinn filed her complaint May 30 in Kanawha Circuit Court against Speedway and Linda Sayre Wackerman, who is the owner of the Ravenswood Speedway location.

According to the complaint, Flinn went to a Speedway in Ravenswood on September 17, 2022, when she tripped on an uneven joint between the asphalt/concrete parking lot and a metal cover for underground gasoline storage tanks.

The injuries she suffered in the fall required her to be admitted to the hospital, and she says the injuries are permanent.

Flinn says the defendants knew of the hazard and failed to provide warning. In fact, she says other customers and/or employees tripped at the same location and reported the accidents.

She also says the defendants had scheduled or had work performed on the parking lot in the days before her injury to try to reduce the tripping hazard.

Flinn accuses the defendants of negligence. She seeks compensatory damages for her injuries, medical expenses, pain and suffering, impairment to her ability to enjoy life, annoyance, aggravation and mental anguish. She also seeks interest, court costs, attorney fees and other relief.

She is being represented by Brent K. Kesner and Anthony E. Nortz of Kesner & Kesner in Charleston. The case has been assigned to Circuit Judge Duke Bloom.
