NorthStone sues for breach of contract

CHARLESTON — NorthStone Insurance Company sued Pena Masonry alleging it breached its contract when it failed to pay more than $25,000.

NorthStone provided workers' compensation and employer's liability insurance from April 10, 2020, until April 10, 2021, according to a complaint filed in Kanawha Circuit Court.

The defendant has failed to pay $25,781 owed as a premium for the policy, according to the suit.

NorthStone claims the defendant breached its contract by failing to pay the premium.

The defendant is and continues to be, in breach of its contractual obligation under the policy by failing to pay its premium for coverage under the policy.

"As a result of defendant's breach of its obligations to pay premiums owed for the policy, defendant has been and continues to be unjustly enriched at the expense of NorthStone in the amount of $25,781.00," the complaint states.

NorthStone is seeking compensatory damages  It is represented by Arnold J. Janicker and Megan L. Southern of Jenkins Fenstermaker PLLC in Huntington.

The case is assigned to Circuit Judge Joanna Tabit.
