Woman files lawsuit against company for car accident

CHARLESTON — A Mineral Wells woman is suing Rokstad Power and one of its employees for a car accident that caused damages and injuries.

Chase M. Meade and Rokstad Power Inc. were both named as defendants in the suit.

Tammy Jones was operating her vehicle on Interstate 77 in Kanawha County on June 15, 2021, when she saw a large object on the road that had fallen off the truck driven by Meade and owned by Rokstad, according to a complaint filed in Kanawha Circuit Court.

Jones attempted to avoid the obstruction but was unable to change lanes because there were vehicles beside her and she hit the object, causing significant damage to the tires on her vehicle and, in turn, caused an accident to occur and Jones became injured, according to the suit.

Meade had been driving on Interstate 77 ahead of Jones in a conventional truck when the object fell off his truck and into the middle of the road, according to the suit.

"Defendants disregarded their duty to operate a vehicle safely on the roadways of this State by failing to ensure the safe operation and maintenance of a vehicle being operated on the roadways of this State and causing an accident in which Plaintiff was injured," the complaint states.

Jones claims she incurred bodily injury, medical expenses, psychological damage, pain and suffering, permanent damage and endured a loss of capacity to enjoy life.

"As a direct and proximate cause of the negligence of Defendant, Plaintiff will continue in the future to incur medical expenses, loss of earning capacity, pain and suffering, psychological damage, permanent damage and endure a loss of capacity to enjoy her life," the complaint states.

Jones is seeking compensatory and punitive damages. She is represented by James R. Leach, Victoria Sopranik and Devyn R. Leach of Parkersburg.

The case is assigned to Circuit Judge Kenneth Ballard.
