Man sues Kirk Trucking for injuries from car accident

WAYNE — A father is suing Kirk Trucking Co. Inc. for his and his son's injuries in a car accident.

William Prater was also named as a defendant in the suit.

On June 21, 2022, Howard Meddings was operating a 2021 Ford F-250 on U.S. 52 near Kermit with James Pack and his minor son, Chase Pack, as passengers, according to a complaint filed in Wayne Circuit Court.

James Pack claims Prater violently rear-ended them when Meddings attempted to pull into a gas station.

Meddings signaled he was turning, slowed his vehicle and then stopped to pull into the gas station. Prater was operating a 2022 Peterbilt 567 coal truck owned by Kirk when the incident occurred.

"The chain of events is corroborated by dash cam footage," the complaint states. "William Prater told the police officer that arrived on the scene that he did not see the turn signal on Mr. Meddings' vehicle in order to stop in time. As a result of William Prater's negligent and reckless conduct, as well as the negligent entrustment of Kirk Trucking Co. Inc., Plaintiff James Pack and minor Chase Pack, suffered significant personal injuries to their bodies and minds."

The plaintiff claims as a direct and proximate result of Prater's negligent, willful, wanton and reckless conduct and the negligent entrustment of Kirk Trucking, the Packs were caused to suffer severe personal injuries to their bodies and minds and sustain physical and mental pain and suffering.

James Pack claims his and his minor son's injuries, damages and expenses are permanent and continuing in nature.

James Pack is seeking compensatory damages with pre- and post-judgment interest. He is represented by Kenneth P. Hicks of Kenneth P. Hicks LC in Huntington.
