Woman sues Enterprise for needle injury in rental car

WAYNE — A Kenova woman says Enterprise Rent-A-Car failed to properly inspect a car she rented and she was allegedly stabbed by an uncapped needle left in the vehicle.

EAN Holdings is doing business as Enterprise Rent-A-Car.

Elizabeth Bailey was in a vehicle owned by the defendant on March 3, 2022, after entering into a rental agreement for the lease of the vehicle from the defendant, according to a complaint filed in Wayne Circuit Court.

Bailey claims she was injured when she was stabbed by an uncapped hypodermic needle that was in a storage pocket of the vehicle. She claims no measures were taken by the defendant to warn her of the condition and the defendant knew or should have known about the needle.

"The Plaintiff, Elizabeth Bailey, while operating said motor vehicle, suffered injury when she reached into the storage pocket of said motor vehicle and was stabbed by the uncapped hypodermic needle, thereby exposing herself to present and future, known and unknown infections, diseases and such other illnesses," the complaint states.

Bailey claims Enterprise had a duty to maintain the vehicle in a reasonably safe condition for those who are leasing vehicles.

"As a direct and proximate result of the negligence of Defendant Enterprise ... the Plaintiff, Elizabeth Bailey, was seriously and severely injured in and about the head, neck, back, body, limbs and was thereby rendered sick, sore, lame and otherwise disabled ..." the complaint states. 

Enterprise's negligence caused Bailey to sustain a loss of earnings and earning capacity, according to the suit.

Bailey claims she has and will continue to undergo painful, extensive medical care and treatment as a result of the incident and she will continue to incur medical expenses because of her injuries.

Bailey is seeking compensatory damages. She is represented by R. Matthew Vital of Vital & Vital in Huntington.
