WINFIELD — A Nitro woman is suing Factory Connection alleging she was injured while shopping in its store at Liberty Square.
Connie Lou Chambers was shopping at Liberty Square Shopping Center on May 29, 2021, when she went to open the door and walk into a store and she tripped and fell over a strip that ran between the store's anti-theft sensors, according to a complaint filed in Putnam Circuit Court.
Chambers claims she landed on her shoulder with great force that it caused her to fracture the upper part of her left humerus bone.
"Upon information and belief ... eyewitnesses stated that plaintiff appeared to trip over the strip that ran between the store's anti-theft sensors and that the strip did not appear to be safe," the complaint states.
Chambers claims the defendant failed to maintain its premises in a reasonably safe condition and caused her to sustain serious personal injuries.
The defendant had a duty to maintain the premises and breached that duty by failing to properly warn her of the dangerous condition and failing to inspect the property for dangerous conditions, according to the suit.
Chambers claims the defendant was also otherwise negligent by virtue of other acts and omissions known and unknown to the plaintiff.
"Defendant's negligence and breach of aforementioned duties...proximately caused injuries and damages to the plaintiff including but not limited to serious bodily injury and tremendous physical pain and suffering, medical expenses, loss of ability to enjoy life, humiliation, embarrassment, annoyance, aggravation, inconvenience, as well as other injuries and economic and noneconomic damages," the complaint states.
Chambers is seeking compensatory damages with pre- and post-judgment interest. She is represented by Joshua R. Martin of The Martin Law Firm in Nitro.
