Three complaints claim injuries from car accident

WAYNE — Three lawsuits allege Todd Case Trucking and one of its employees are responsible for a car accident that caused injuries.

Lilly M. Gissel, Camree Davis and Krystal Keene, as next friend and natural parent of Desiree Keene filed the lawsuits against Todd Case Trucking and Matthew Whited in Wayne Circuit Court.

On March 15, 2022, Gissel operated a 2009 Honda Accord on Tolsia Highway near the Paddle Creek Marathon in Fort Gay while Whited was operating a 2011 tractor and trailer directly behind Gissel's vehicle.

Whited failed to stop his vehicle and violently struck Gissel's vehicle, according to the suits.

"There were three passengers in her vehicle," one of the complaints states. "An independent witness who saw the motor vehicle collision stated that Defendant Matthew Whited was the cause of the collision. As a result of Matthew Whited's negligent conduct, as well as the negligent entrustment of Todd Case Trucking Inc., Plaintiff Lilly Gissel suffered significant personal injuries to her body and mind."

Davis and Desiree Keene were passengers in Gissel's vehicle, according to the suits.

The plaintiffs claim they suffered injuries to their bodies and minds; sustained physical and mental pain and suffering; suffered from diminished capacities to enjoy life; loss of household services; incurred expenses for medical treatment and hospital care; and suffered annoyance and inconvenience.

"In addition, those injuries, damages and expenses are permanent and continuing in nature," the complaints state.

The plaintiffs are seeking compensatory damages with pre- and post-judgment interest. They are represented by Kenneth P. Hicks of Kenneth P. Hicks LC in Huntington.
