Erie sues N.C. business whose driver struck Drug Emporium's sign

CHARLESTON — Erie Insurance is suing Cardinal Logistics Management Corporation alleging it needs to reimburse the insurer after one of its drivers damaged a sign at a Charleston business.

Erie Insurance insured Drug Emporium in Charleston and on Feb. 26, 2022, the business sustained damages made by Cardinal Logistics when a driver for the defendant struck Drug Emporium's sign with their truck, according to a complaint filed in Kanawha Circuit Court.

Erie, which has a principal address in Erie, Pa., claims Cardinal, a North Carolina business, caused major damages to Drug Emporium property because of the incident. 

Drug Emporium sustained property damages because of the defendant's employee's actions, according to the suit.

"On or about February 26, 2022, a driver for Cardinal Logistics Management Corporation did cause damages to the Plaintiff's business by acting in a grossly negligent and reckless manner, by hitting the Plaintiff's sign with their truck," the complaint states.

Erie claims pursuant to the contract of insurance, Erie paid $13,320.80 to Drug Emporium.

Erie is seeking damages in the amount of $13,320.80 with pre- and post-judgment interest. It is represented by Clinton W. Smith in Charleston.

The case is assigned to Circuit Judge Maryclaire Akers.
