Woman sues Door Dash, driver for accident in Cross Lanes

CHARLESTON – A St. Albans woman says she was injured in a car accident caused by a Door Dash driver.

Sandra M. Garrett filed her complaint in Kanawha Circuit Court against Door Dash Inc. and Kennith Daniel Lupson.

According to the complaint, Garrett was driving on Big Tyler Road in Cross Lanes on June 29, 2021, when Lupson failed to maintain control of his vehicle and failed to yield the right of way to Garrett when he ran into her vehicle by pulling in front of her and causing a T-bone collision.

Lupson was delivering or returning from a delivery for Door Dash at the time of the accident.

Garrett says she sustained serious and permanent injuries from the accident and has incurred medical expenses as well as pain and suffering. She says she also has suffered a loss of enjoyment of life and has been unable to perform her job duties and suffered lost wages.

She seeks compensatory damages, interests and court costs.

Garrett is being represented by Shannon M. Bland of Bland & Bland in Charleston. The case has been assigned to Circuit Judge Maryclaire Akers.
