Woman sues nursing home for grandmothers injury, death

CHARLESTON — A woman says Eastbrook Center is responsible for the death of her grandmother.

Eastbrook Center is doing business as Stonerise Charleston.

Dawn Lemle filed the lawsuit on behalf of the estate of Caroline E. Williams, who was a resident of Stonerise Charleston, according to a complaint filed in Kanawha Circuit Court.

Lemle claims the defendant deviated from the standard of care and was negligent by allowing Williams to fall and fracture her hip.

Williams fell on May 22, 2022, and was taken to Charleston Area Medical Center on June 2, 2022, to determine she had a fractured right hip, according to the suit.

Lemle claims the defendant failed to timely send Williams for evaluation and treatment for her broken hip and was negligent in her ongoing health problems.

"As a further direct and proximate result of the negligence of Defendant...Williams, deceased, had suffered physical and mental pain and suffering, severe emotional distress and incurred medical expenses," the complaint states.

Williams died on June 26, 2022, and suffered complications following the defendant's failure to properly recognize and remedy Williams' condition after her fall the month before, according to the suit.

"That the defendant, in negligently providing care and treatment to Plaintiff, Caroline Williams, deceased, acted in willful, wanton and reckless disregard for her well-being and health, and plaintiff is entitled to an award of punitive damages in an amount sufficient to punish them for their misconduct and to deter them from any such future misconduct," the complaint states.

Lemle claims she sustained pain and suffering, severe emotional distress and loss of kindly services from the death of her grandmother.

Lemle is seeking compensatory and punitive damages with pre- and post-judgment interest. She is represented by Charles M. Love IV of the Love Law Firm in Charleston.

The case is assigned to Circuit Judge Jennifer Bailey.
