CHARLESTON — The West Virginia Department of Transportation, Division of Highways is suing Jeremy & Alex Trucking Inc. claiming the trucking company is liable for damages to a highway structure caused by one of the trucking company's employees.
On June 28, 2021, Rodney Jarrett, an employee of Jeremy & Alex Trucking, was driving a 1999 Classic Freightliner truck tractor and pulling a flat-bed trailer with a rebar cage that were both owned by Jeremy & Alex Trucking when a collision occurred, according to a complaint filed in Kanawha Circuit Court.
The DOH claims the collision caused significant damage to property owned by the plaintiff and that Jeremy & Alex Trucking is liable for the damage caused by its vehicle to the highway structure in which Jarrett struck.
Jarrett was acting within the scope of his employment and/or agency operated by Jeremy & Alex Trucking's tractor-trailer in a careless, negligent and illegal manner, according to the suit.
The DOH claims Jeremy & Alex Trucking is at fault as it is the owner of the negligence for which the damage had occurred.
"As a result of the aforementioned collision, the West Virginia Department of Transportation, Division of Highways to date has incurred damages and costs in the amount of thirty-four thousand, five hundred sixty-one dollars and ninety cents (34,561.90) for damage to asphalt and traffic control," the complaint states.
The DOH is seeking judgment in the amount of $34,561.90 with interest. The DOH is represented by Stacy A. Jacques of the DOH in Charleston.
The case is assigned to Circuit Judge Maryclaire Akers.
