CHARLESTON – An Ohio man says he was injured by a patio umbrella while visiting Mardi Gras Casino & Resort.
Robert Prichard, who lives in South Point just across the Ohio River from Huntington, filed his complaint in Kanawha Circuit Court against Cross Lanes Gaming & Entertainment doing business as Mardi Gras Casino & Resort.
According to the complaint, Prichard was visiting the resort May 7 and was seated in a fenced outdoor area at a round table with a patio umbrella and four seats across from a companion when the umbrella at his table dislodged from the base and struck him in the head.
The complaint says a female employee witnessed the incident, and Prichard filed a report with another resort employee. Prichard says he suffered catastrophic, severe and permanent injuries, but the complaint does not elaborate on those injuries.
He accuses the defendant of negligence, and he seeks compensatory damages for medical expenses, future medical care, lost wages, economic costs caused by the incident, physical and emotional pain and suffering, emotional distress, mental anguish, loss of enjoyment of life, annoyance and inconvenience. He also seeks other damage, pre- and post-judgment interests, attorney fees, court costs and other relief.
Prichard is being represented by Benjamin D. Adams and Mark E. Troy of Morgan & Morgan in Charleston. The case has been assigned to Circuit Judge Maryclaire Akers.
