Huntington woman sues rental property owner for injuries

HUNTINGTON — A Huntington woman is suing B&B Property Management alleging she was injured while on its rental premises.

Melissa D. White was at the defendant's rental property on Adams Avenue in Huntington on Aug. 8, 2022, when she was caused to slip and fall as a result of a dangerous and hazardous condition, according to a complaint filed in Cabell Circuit Court.

White claims there was a rotted and unsafe deck that was in disrepair, which was dangerous and hazardous and was known to the defendants.

"The Defendant had a duty to maintain said premises in a reasonably safe condition for the persons...who are upon said premises and/or to provide sufficient notice and reasonable warning of dangerous and hazardous conditions, which duty or duties the Defendant breached, resulting in the negligent and careless control and maintenance of said premises," the complaint states.

White claims as a direct and proximate result of the defendant's negligence, she was seriously and severely injured when she slipped and fell through the deck. She was rendered sick, sore, lame and otherwise disabled as a result of the defendant's negligence.

White has in the past and will in the future continue to suffer great pain and anguish of body and mind, injuries of which are permanent in nature.

As a result of the defendant's negligence, White had to undergo painful and extensive medical care and treatment and will continue to incur medical bills and expenses in the future, according to the suit.

White claims the defendant breached its duty of care, resulting in the negligent and careless control and maintenance of the premises.

White is seeking compensatory damages with interest. She is represented by R. Matthew Vital of Vital & Vital in Huntington.

The case is assigned to Circuit Judge Alfred E. Ferguson.
