Former employee sues Health Transport Company for disability discrimination and retaliation

CHARLESTON – A woman accuses her former employer of disability discrimination, failure to accommodate and retaliatory termination.

Plaintiff Lynette Jo Compton filed the lawsuit in Kanawha Circuit Court against Healthteam Critical Care Transport alleging discrimination and retaliatory termination in violation of the West Virginia Human Rights Act.

According to the lawsuit, Compton was employed by Healthteam through August 4, 2021. She claims she suffered a back injury and reported to her employer that she had a disability that limited her ability to lift objects.

When her employer found out about her disability, Compton alleges it discriminated against her disability and retaliated against her by refusing to provide her accommodations to complete her duties, forcing her to take on duties with heavier lift requirements while not asking other employees to complete any lifting before eventually terminating her from her position.

The complaint says Compton was a protected individual under the West Virginia Human Rights Act, which prohibits employers from discrimination based on disability, perceiving disability, regarding someone as disabled, or failing to accommodate a disability.

Compton is seeking monetary damages for lost wages and benefits, mental and emotional distress, court costs, attorneys fees and any other relief the court deems proper. She is represented in this case by attorney D. Adrian Hoosier of Hoosier Law Firm in Charleston.
