Dirty Birds sue sponsor for failure to pay

CHARLESTON – The Charleston Dirty Birds baseball team has sued a Beckley company for failing to pay for its contracted sponsorship of the team.

Charleston Professional Baseball Company LLC filed its complaint September 14 against Kontempry Ltd. Co. doing business as Freebets.us.

According to the complaint, the defendant signed a two-year sponsorship agreement with the team to purchase a canopy sign and digital website banner ad. The defendant was to pay $1,500 for 2021 and $23,625 for 2022.

The company paid the 2021 amount but failed to pay the 2022 amount. Still, the team provided the defendant with the canopy ad and digital banner ad.

The Dirty Birds say game attendance increased more than 35 percent from 2021 to 2022, maintaining the defendant received “considerable benefit” from the ads and was unjustly enriched by the sign and ad.

The team seeks the $23,625 plus the contractual 18 percent interest, attorney fees and court costs.

The Dirty Birds are being represented by Ben Salango of Salango Law in Charleston. The case has been assigned to Circuit Judge Maryclaire Akers.
