South Charleston couple sues Perry Construction for alleged failure to properly install roof

CHARLESTON — A South Charleston couple is suing Perry Construction for failure to properly install a metal roof.

William Perry, the owner of Perry Construction, was also named as a defendant in the suit.

Randall Kirk and Lolita Kirk orally contracted with Perry Construction in November 2021 for the installation of a metal roof and soon after, the defendants began working on the roof, according to a complaint filed in Kanawha Circuit Court.

The Kirks claim they soon after noticed subpar work being done on the roof and the defendants abandoned the project.

"The deficiencies and abandonment of the world on the installation of the roof prevented the plaintiffs from installing gutters to direct water from entering the home and its foundation," the complaint states. "The lack of workmanship of the defendants and careless work while installing the metal roof is directly responsible for damage to the exterior vinyl siding of the home."

Despite reaching out to the defendants multiple times, the Kirks received no response, according to the suit.

The Kirks claim they paid in full for the project, which they claim was not completed, in the amount of $15,000 and the defendants' faulty work also caused their home extensive damages.

The Kirks are seeking compensatory and punitive damages with pre- and post-judgment interest. They are represented by Joseph H. Spano Jr. of Pritt & Spano in Charleston.

The case is assigned to Circuit Judge Tera Salango.
