HUNTINGTON — An Ohio couple is suing Felman Production for a work injury.
Mark A. Davis was a maintenance worker for Felman and was injured on Aug. 25, 2021, during the course of his employment, according to a complaint filed in U.S. District Court for the Southern District of West Virginia
During a planned furnace outage, there were six maintenance workers in the process of replacing slipping bands and the employees worked from a catwalk that was between 14 and 16 inches wide, 15 feet above the floor and accessed by a ladder, according to the suit.
Davis claims the employees did not have any type of fall protection while they were replacing the slipping bands from the elevated catwalk and Davis was working on replacing the bands when he fell from the elevated catwalk to the surface below, resulting in serious injuries and hospitalization.
Davis was transported to Holzer Emergency Department in Pomeroy, Ohio, and was then transferred to Grant Medical Center in Columbus, Ohio.
The defendant did not report the hospitalization to OSHA within the required 24 hours and when OSHA inspected the scene and investigated the incident after it was reported to the agency, the agency issued a serious citation to Felman, the complaint states.
Davis and his wife, Mary A. Davis, are seeking compensatory damages with pre- and post-judgment interest. They are represented by J. Ryan Stewart of Bailey Javins & Carter in Charleston and Bradley H. Layne of Kayser, Layne & Clark in Point Pleasant.
