CHARLESTON — A man is suing Moses Chevrolet for a faulty vehicle he purchased.
FCA US LLC and Transportation Network LLC were also named as defendants in the suit.
Joseph Donchatz Jr. purchased a 2015 Jeep Cherokee on April 1, 2020, from the defendants and was told the vehicle had an extended warranty, according to a complaint filed in Kanawha Circuit Court.
Donchatz claims despite the warranties he was told about, he discovered the vehicle had serious defects and the repairs were not covered under warranties that they should have been.
The vehicle has been in the shop multiple times for recalls, an improperly-working air ride, fuel pressure problems, leaking coolant, motor and transmission problems and the check engine light illuminating, according to the suit.
Donchatz claims the vehicle currently has an open recall, but the dealerships are unable to obtain parts.
"In this regard, Defendants have improperly disclaimed and breached the applicable warranties," the complaint states. "Plaintiff was given various excuses for why the repairs were not covered by warranty, including that the vehicle is a Canadian vehicle."
Donchatz claims when he purchased the vehicle he was not informed that it was a Canadian vehicle, nor that this designation would impact the warranty coverage.
Donchatz is seeking compensatory and punitive damages. He is represented by Kristina Thomas Whiteaker of The Grubb Law Group in Charleston.
The case is assigned to Circuit Judge Maryclaire Akers.
