Woman says she was victim of discrimination, wrongful termination by medical clinic

CHARLESTON – A former employee says she was discriminated against and wrongfully terminated by a McDowell County medical clinic.

Amanda Bostic filed her complaint September 22 in Kanawha Circuit Court against Bradshaw Medical Clinic and Dr. Mahesh B. Patel.

According to the complaint, Bostic worked for the clinic from July 2011 through June 2022 as office manager.

A week or so before her termination, Bostic says her child had to be rushed to Charleston Area Medical Center. While with her child, Bostic says she started feeling extremely ill. But she was asked to return to work, and she did.

While at work, Bostic says she experienced painful symptoms related to an ongoing medical condition or disability. She complained to the nurse practitioner at the clinic who prescribed her medication for that condition or disability. The nurse practitioner also allowed Bostic to go home.

The next day, Bostic was terminated.

She accuses the defendants of violating the West Virginia Human Rights Act based on disability, failure to accommodate and being perceived as disabled.

Bostic says she has suffered loss of income, emotional pain, suffering, humiliation, aggravation, annoyance, inconvenience, mental anguish and other injuries. She seeks compensatory damages.

She is being represented by D. Adrian Hoosier II of the Hoosier Law Firm in Charleston. The case has been assigned to Circuit Judge Jennifer Bailey.
