Woman sues apartment complex owner for injuries

CHARLESTON — A woman is suing M&M Enterprises Nitro alleging she was injured when she fell down some stairs.

Millard Mitchell, RPM Rentals, Meeks Rentals & Leasing and John Does 1 through 6 were also named as defendants in the suit.

Terri Snodgrass was a resident of an apartment complex owned by the defendants in Nitro and went down the exterior wooden stairway on Aug. 28, 2021, after sunset in the dark, according to a complaint filed in Kanawha Circuit Court.

Snodgrass claims she was using reasonable caution in coming down the stairs, however, due to the dangerous conditions of the stairs, including incomplete and partially nonexistent handrails; partial rubber treat that was broken; and there being no lights on the stairway, she fell until she reached the bottom of the stairs.

The plaintiff suffered a broken femur, which required surgery and placement of metal, leaving her with a permanent limp and pain, according to the suit.

Snodgrass claims she suffered permanent and debilitating injuries due to the defendants' breach of duty and negligent conduct.

Snodgrass is seeking compensatory damages with pre- and post-judgment interest. She is represented by R. Edison Hill of Hill, Peterson, Carper, Bee & Deitzler in Charleston.

The case is assigned to Circuit Judge Tera Salango.
