Man sues solar paneling company for system that didn't work

HUNTINGTON — A man is suing Design 1 Group alleging the solar panelling he purchased did not meet his expectations.

Charles Bouck contacted Design 1 Group in 2020 to learn about solar panel systems, according to a complaint filed in Cabell Circuit Court.

Bouck claims on Dec. 19, 2020, a salesperson came to his residence to show him promotional videos and answer questions and the salesperson then inspected his home and proposed a system they alleged was suitable for the residence and its power needs.

Design 1 also offered a discount or rebate to Bouck if he purchased the solar panel system that day and the salesperson used this discount or rebate to pressure Bouck into purchasing the system that day, according to the suit.

Bouck claims he did not want the system installed on his home, but the land adjacent to his home and the salesperson assured him it would not be a problem.

The cost of the system was $44,511 for 10 solar panels and Bouck questioned if 10 solar panels was sufficient for his residence, considering he had a pool, a tanning bed and a hot tub, but the salesperson assured him it was, according to the suit.

Bouck claims the defendant was supposed to install the solar panels in February 2021, but failed to do so. The defendant then came in July 2021 to do so and, upon arrival, the defendant informed him that the system could not be installed on the land adjacent to the home. 

The plaintfill was then offered $1,000 and two more solar panels if allowed to put install the panels on the roof, to which Bouck agreed, according to the suit.

Bouck claims the solar panels have failed to reduce Bouck's electric and/or power bill, as represented as Design 1.

Bouck is seeking compensatory and punitive damages. He is represented by R. Scott Long, Stephen E. Hastings, David F. Nelson and John K. Cecil of Hendrickson & Long in Charleston. The case is assigned to Paul T. Farrell.
